PORTSMOUTH — A 52-year-old Portsmouth man was arrested on the Fourth of July after he was found to be in possession of $4,000 to $5,000 of illegal fireworks, police said.

Police responded to 99 West Passage Drive around 10:10 p.m. after a state fire marshal observed a large quantity of fireworks being discharged at that address, according to police.

Police determined that Eric W. Sundermann, of 99 West Passage Drive, was in possession of the fireworks and had already discharged a large majority of them.

He was charged with illegal possession and use of fireworks, given a 2nd District Court summons and released.

In Rhode Island, only ground and hand-held sparkling devices (“sparklers”) are legal for use by the general public. No one can sell, use or possess display fireworks or aerial consumer fireworks.

Any firecrackers, rockets, mortars, or any other device that launches a projectile and/or makes a “bang” or detonation are illegal in Rhode Island.

After he was woken up, he appeared disoriented and confused, and displayed obvious signs of impairment, police said. Mr. Weaving told police he takes Aderall and Xanax regularly, but did not have his prescription with him. He failed a field sobriety test, and was also charged with driving under the influence of alcohol or drugs, his first offense. After having a blood test at Newport Hospital, he was held overnight pending his arraignment in 2nd District Court in Newport the following morning.
