A Rhode Island District Court Judge on Monday approved a temporary restraining order against David Barboza, after a 45-year-old Bristol man submitted an affidavit and complaint stating that the former town councilor had threatened him in recent weeks over his fear that he had gone to Rhode Island State Police to report Mr. Barboza’s alleged past sexual misconduct.

The man, whom the Bristol Phoenix is not identifying, wrote in an affidavit that he has known Mr. Barboza for nearly 30 years, and that he first exhibited inappropriate behavior as far as 1992.

“The first incident was in 1992 when he was intoxicated and he would rub his erection on me and call me ‘Gullible’ with a Capital ‘G,’ ” he wrote in the affidavit.

“This would go on over the years. I would see him out and about and it would always turn sexual.”

He wrote that he was never interested in Mr. Barboza’s sexual advances.

On Monday, Sept. 16, he wrote, Mr. Barboza came to his home on High Street and “told me I’m going to burn in hell for ‘throwing him under the bus,’ because he thought I went to the state police.”

He also alleged that Mr. Barboza told his mother that “if he sees me he will run me over.”

“We have been receiving hang up phone calls (and) David has been driving by the home as well. David said he would rather murder me and go to jail instead of going to jail for being ‘gay,’ ” he wrote. “I don’t want to be harassed anymore and don’t know what he’ll do.”

On Tuesday, Oct. 1, District Court Associate Justice Christopher Smith approved the man’s request for a temporary restraining order. Under the order, Mr. Barboza, a former Bristol Fourth of July chief marshal, town councilor and civic leader, is barred from “contacting, assaulting, molesting or otherwise interfering with the Plaintiff at home, on the street, or elsewhere,” and is ordered to surrender all firearms in his possession.

The order will remain in effect until a hearing scheduled for Monday, Oct. 21.
