TIVERTON — A Tiverton man, Scott W. Banville, 44, who was shot by police at 11:34 last Wednesday night at his home while wielding a 50 caliber rifle during a domestic dispute, was released from Rhode Island Hospital Sunday night after treatment for his injuries.
Mr. Manville had been arraigned by a justice of the peace the night of the incident on charges of felony assault with a dangerous weapon and with domestic disorderly conduct, and faces re-arraignment on the charges this Thursday in District Court in Newport.
He was released from the hospital Sunday night on his own recognizance, on $10,000 bail. He is under a no contact order with his spouse. His rifle was confiscated the night of the incident. There are and .
The officer-involved shooting remains under investigation by the Rhode Island Attorney General's Office and the State Police, said Tiverton Police Chief Patrick Jones Monday night. The officer, Scott Beaulieu, is an 18 and a half year veteran of the department, Chief Jones said, and is on administrative leave pending final clearance from the investigation and a final determination of "whether the shooting was justified."
The call about the domestic disturbance resulting in the shooting came in at 11:31 p.m. last Wednesday. It had been alleged that Mr. Manville in his home at 222 Pelletier Lane in Tiverton had drawn a gun on his wife. A child and a pet dog were reported was reported to be in the house at the time.
At least 14 police officers, two rescue vehicles, a fire truck and command vehicle, and numerous fire department personnel responded to the scene.
At a briefing following the incident, Chief Jones said Mr. Banville was holding the gun and lifted the 50 caliber weapon at police. That was when officers fired and shot the man.
