Motocross park at old quarry site draws neighbors’ ire and town’s fire
TIVERTON — A major land use and zoning battle is shaping up in town. On one side are hundreds of dirt bikers and all-terrain vehicle (ATV) enthusiasts, who are flocking to a “motocross park” at an old quarry near 691 Brayton Road, and the quarry’s owner.
On the other are several dozen nearby residents whose neighborhood is zoned R-80 for residential use, and the Town of Tiverton.
The neighbors have filed a petition with the town, which was on the Town Council agenda Monday night and was referred, without action, to the zoning official and the town solicitor — “not a council matter,” said Donald Bollin, town council president, before the meeting began.
Upping the ante, Town Administrator James C. Goncalo confirmed Monday that the town would soon go to court to seek an injunction against motocross activities at the quarry.
The court action follows two notices of zoning violations issued by town zoning official Gareth Eames (on Sept. 28 and Oct. 19) to Raymond E. Johnson, the quarry owner, charging him with operating a motocross business and with operating a campground on the property in violation of the zoning standards that apply in an R-80 residential area.
Each day a violation continues constitutes a separate offense with possible fines of up to $500 per day for each violation.
So far, at least, Mr. Johnson gives little evidence of suspending motocross activities at the quarry tracks he is building. Last weekend, an estimated 200 dirt bikers and quad operators (four-wheeled all-terrain vehicles) motored over the tracks, most paying what Mr. Johnson calls a $20 to $25 “donation” at the entrance gate.
In the beginning
Motocross activity started there in earnest last July.
Mr. Johnson, facing what he says is a declining quarry business and a need “to reclaim the property,” is building what he has named “MX 691” and has created a website by that name.
The website calls the quarry“Rhode Island’s exclusive off-road riding park.” It’s all “part of an exit strategy from the quarrying operation,” Mr. Johnson said.
Mr. Johnson said that he’s building a “motocross park,” with three racing tracks, seating, and appropriate facilities, and that “parks” are permissible in R-80 zones. He said he intends to seek a variance from Tiveton’s zoning ordinance.
Triggering events
The inaugural event at MX 691 was a motocross rally in the old gravel quarry on July 11 and 12.
Guests camped overnight, hot dogs and hamburgers were served, port-a-potties were hauled in, banners were flown, and for much of the two days the sound of dirt bikes and quads carried over the neighborhood. One neighbor likened the spectacle to an event broadcast over ESPN.
Another similar event (a “Trail and Track Ride”) was held the weekend of September 12 and 13. A third event, billed as the “5th Annual Meeting of the Rhode Island Off Highway Vehicle Association (RIOHVA) and Ride,” was scheduled for Sunday, November 15, but was canceled “due to land use issues beyond our control,” as the RIOHVA website announcement put it.
Petitions from both sides
The motocross activity generated a neighborhood petition, which in turn has inspired a counter-petition from the bikers. The neighbors circulated their petition in early October (it was the one presented it to the council last Monday night). It was signed by 28 nearby residents, who don’t like the noise and claim that residential zoning ordinances are being violated.
One of those who (with her husband) signed and helped circulate that petition is Cynthia Sturgis. She lives across Brayton Road from Mr. Johnson’s motocross operation, and is a former planning board member. She and her husband have lived in the neighborhood since 1995.
“This is not appropriate,” Ms. Sturgis said. The quarrying use was grandfathered in when the R-80 residential zone was created by the zoning ordinance, she said. Mr. Johnson “can’t run a race track here.”
Ms. Sturgis can hear the motocross activities from her home, and said that as recently as Sunday numerous off-road vehicles passed up and down the road in front of her house. Last weekend, she said, she was at the town farm with her children and could hear the noise from there as well.
The counter-petition“in support of the MX 691 — the future Motocross Park,” has been signed by an estimated 300 people, most of them dirt bike and quad riders, or their family members. Mr. Johnson drafted it. Last Sunday alone, he estimated 180 signatures were gathered from those who came through the gate to ride.
Two of those who signed Mr. Johnson’s petition last Saturday were Brian and Wendy Wilkie, who Mr. Johnson said are abutters. While signing, and clearly referring to opponents of the park, Mr. Wilkie said to Mr. Johnson, “we used to have one neighbor, now we have 20.”
Mr. Johnson’s petition sits on a table at the entrance gate where admission “donations” are collected. He said 30 to 40 bikers visit daily, with more on weekends.
Track types, charges, risks
Mr. Johnson, with his partner Gary Duval, a track builder, is installing three tracks. One is a kid’s track that Mr. Johnson said is for children 16 and younger. It features a small “whoop section, safe table tops, high banked berms, straights, and single jumps.”
A second“MX track” for all levels of expertise, will be a large scale open course featuring multiple jumps , uphill climbs, and a “gravity cavity.”
The third track is a five-mile “Enduro Loop” through the woods that will include “rock gardens, hero sections, open trail, up-hills, tight woods, and water crossings.”
Those entering the MX 691 motocross park are asked to sign a release of liability, and “become a member for a day,” said Mr. Johnson. There are risks. “There have been some injuries, absolutely,” Mr. Johnson said, one serious — a couple of bone breaks and broken shoulders, some broken ribs, a ruptured spleen.
Tiverton Fire Chief Robert Lloyd said, “we’ve already had numerous incidents there. Somebody’s eventually going to get killed there. And when somebody gets injured out there, they’re going to look to us.”

Odd, that sounds of heavy equipment, jack hammers, and dynamite didn't bother all of the newly found neighbors, but 'bwaaaahh, bwaaaah' from dirt bikes does.
Could be some folks desperate to become ex-Rhode Islanders, but have no chance of selling with a quarry/dirt bike park there.
Moral of the story? Don't buy property that abuts quarrys landfills, fire stations, or nuclear weapon proving grounds, then complain.

I used to ride on Amy Hart Path in LC, they tried to shut us down there, now there trying to shut MX691 down. I have one thing to say; Let Us Ride!
I am a "neighbor" to this track, last weekend I was presented with their "petition" to sign against the track. Let me just say that the street I live on has approximately 70 homes.......we're up the street a bit from the site.......although we can hear those bikes everyday/weekend I chose not to sign against the track as most of my neighbors did. 28 signatures in this area is a laugh! There are at least 200 homes within "hearing" distance of this track. Most of us say leave them alone and enjoy a sport riding in a place designated for that! To the Tiverton fire chief.......sorry to hear your asinine comments but you are getting paid to make those calls! If they choose to ride and know the risks, which they do because my boys ride there as well and they get hurt then you're only doing the job you're being paid by us taxpayers to do! Maybe you should focus on keeping your firemen/paramedics sober enough to preform their jobs and not worry about people having some recreational fun of which they are well aware of the risks.

Dear opinion, you say you did not sign the petition like you were just above doing so but then reveal that your sons ride there so of course you did notbsign it. Your final assinine commentbseems to directed towards the death of Jerry Leduc. Jerry was a good man who died trying to help someone. Yes he had been drinking but he wad off duty so what did the Cheif have to do with it. Jerry made a mistake but that should not belittle the fact that he was trying to do the right thing. On the other topic if the park was to be for children only that would be great and it seems that a tidy profit may be made from this "park." How about a BMX park so the kids can get some aerobic exercise. while not disturbing the neighboors seven days a week or fill it in and make a fishing park.

Are you aware that the property is up for foreclosure? So there is no "profit" to be made, he's trying to save his property. If it goes to the bank and in fact there have been several auctions held already in which no one has bid on the property then Tiverton stands to lose more tax dollars.

I respect your opinion on both of the issue and hope can avoid foreclusure with a business that fits the zoning regs. No I don't livebin the area of thevteack but i do live in Tiverton.
It was a commercial business with trucks in and out all day long......I do not see how it's any different now. Well then just to inform you this place is not noisy seven days a week as you put it. I hear them on the weekends mostly......however it was no different without the park because kids illegally rode the pipe lines all the time........not to mention riding through wetlands.........so now they found a place to do it as safely as possible and people squawk. I would rather if my kid does get injured be in a accessible place where help can arrive in a timely fashion rather than deep in the woods where it takes a long time to reach them. Because if you do not think kids are riding all through this town in every single patch of woods they can find then you're naive.

Well I dont live there I know kids ride the ATV's around my neighborhood here in bristol on the streets at times. I consider this very dangerous. I think that if they did allow this man to make it a business there and a campground that would benift the town of tiverton. Seems to me there is not much else this land can be used for without putting enomous money in to the land itself.
As for the noise perhaps they could require that all ATV's used on the grounds be reqired to have a exhaust system that brings the noise level down. In this day and age must be a way to do that. Perhaps there is an attachment that the owner could rent or sell to do this. Dont know if thats availible but it would be something to look into.
As for the injury problem that is a whole different animal if it became a business there would have to be a large insurance policy by the owner or proof of insurance by the riders before being allowed to ride there im sure there are other places around that could be looked into for this.
The Firefighter comment was uncalled for blaming the whole department for the wrongs of a few should never be done. Personally "justmyopinion2" no-one is perfect and I underastand Firefighters are held to a higher standard and should be, but that is no justifacation to denigrate an entire department for the actions of 1 or a few.
If you said it in the heat of the moment fine as I said no-one is perfect but in my opinion you should apoligize for that comment I sure as a parent you would not allow your children to make such statements against a group of people just because one person in the group did something wrong.

watchman, I pretty much had that all figured out myself and I love when people actually put their two cents in and really know not what they speak about. Like for instance the whole making a profit comment. The problem with Tiverton residents is they're quick to complain that the town doesn't have enough revenue yet are even quicker to throw people out who are contributing to the tax roll. If this property gets lost to the bank they might as well kiss a huge amount of tax dollars goodbye. Who's going to have to make up for that loss? The taxpayers! Then they'll complain their taxes are high. No one will buy this pretty much useless piece of property.

Well I agree that the chief chose his words badly and his staement makes no sense to me either it is his job and what he is paid for to have people look to them for help.

Rastabri, he needs to raise a substantial amount of money to get his property back. It IS in foreclosure. The bank has attempted several auctions. My point is if he loses this property to the bank who is going to pay the property taxes? Surely the value will plunge on an empty good for nothing hole in the ground. He is attempting to get himself out of foreclosure......and a majority of the neighbors are not complaining it's those select few like every town has.
I cannot comprehend how the neighbors had no grievance with big trucks going in and out all day.......loads of stone, gravel and such being dumped in and out of trucks by the hundreds a day. Know how much noise those tailgates make when they bang after dropping a load? Or how loud the excavator is when he dumps rocks in the back of those trucks? No one complained then and now they all have a gripe. When their taxes go up because they want him out hopefully they'll keep their mouths shut and not complain but I doubt it.
With all the problems that have been in the paper over the last year of things going on in tiverton it strikes me as odd that a former planning board member is still weilding so much power at least that what it looks like to me. Why this state constantly screws businesses instead of helping them is just plain stupid.

Ray Johnson Has scraped a living out of this quarry and employed several guys for years.The economy has hit all of us hard,businesses need to be innovative to survive.I wish him luck, but I don't see him prevailing with the zoning board.He is a preexisting nonconforming use, and can not expand or change use under the current zoning ordinance.I don't believe the zoning board can issue a special use permit even if he could show a hard ship. I might suggest cranberries and cat fish ponds,like i've seen in Carver Mass.Short of a change to the zoning ordinance,I don't see the dirt bike track happening.
Is the one on Fish Road zoned commercial? I'd like to know if it is or not because no one can see it from the road and they're really are no neighbors........if it's not perhaps what's good for the goose should come into play here.
I believe that area on fish is still light industrial, from there to the little store has been changed to high way commerical .The rest of fish road is residential. Sousa road was changed to residential to block development.90 percent of all the main roads in Tiverton were changed from commercial to residential years ago.That is why so many businesses fail, they can't change with the times.
The quarry that is down fish road allmost to the end is in a residential area.There the ones who had all the water problems last year.Viking stone.Keep in mind that the weight restriction on the bridge limits there area for sales so the quarries in Tiv. are hurting.
No Joe, I'm talking about the man who runs a small race track for those little midget race cars that the kids participate in. This place is almost across the street from where that new development went in last year. He has a very long driveway and it goes way back into the woods......I'm just curious as to why he's been able to have a race track there for years.
I know the owner of Viking stone, and let's not open that can of worms with the whole water issue. Tiverton did a great job of sweeping their contribution to that problem under the rug and placed the blame on Greg and his business........too bad there were some old timers who recalled the Town placing the drainage pipe under Fish road and sending it right toward the houses that was placed years ago..........it doesn't worked plugged up.......and although he was hurting for a while he's doing ok now with the development of Sandywood Farms.....he's working in there and hauling over to his place on occasion so no bridge worries there.

Ok RIpolitics, spends hundreds of thousands of dollars for the purchase of the land to put leaves that compost in 3 months to a year? Makes a lot of sense to me! The problem at the landfill is not leaves it's all the other crap that doesn't compost in the landfill. Yes the leadership needs to smarten up but that idea isn't a step in the right direction. Of course that is just my opinion.

Still think this is all a travesty of justice against a small businessman for no reason other than they can do it. Leave this man alone let him have his business any hopefully save his land and keep it on the tax rolls. It is an easy to regulate this business and you will obviously keep some people working. I just cant see the logic in all of this.

Jack, I agree wholeheartedly with you. This man is grasping at straws trying to save his property of which he has owned for a good number of years. If these "neighbors" who are complaining get their way and they lose this revenue on the tax rolls they're going to be the first to complain that the taxes are always going up. I have been a life long property owner in the town of Tiverton and it's always the same old story with the "newer" people who come to this town.......they don't like change.....people need to survive, kids need something to do to deter them from criminal activity and it's always the same "not in my backyard" mentality. At some point it's got to change and people need to realize that REPLACING and existing business isn't going to hurt Tiverton it's going to help us.

Oh and just because I am a concerned citizen about our landfill I happily pay 50 bucks a month to allied waste for a container in my yard along with recycling bins to be picked up. I do not use the towns service. Thank you very much!
The only coarse of action I see that will change the out come for the quarry is if some one gets on the agenda for the town council.There request would be to change the ordinance for this business.This council has changed zoning on properties before to promote business in the town,and also to stop businesses from building. They would have to request a public hearing for the zoning change.It could be done if some one had the will and support of the council,along with public support. I have not seen the public will to change zoning back to allow businesses to grow in Tiverton.People seem to love Tiverton as a bed room community.
You know what the problem with that mentality is Joe? If Tiverton continues to force business out the bedrooms are going to become so expensive that people will be forced out of this town.
I find it very disturbing that the everyday folk who have been life long residents of this town have had to sell their homes and relocate to a cheaper alternative because in their retirement years they were unable to afford their home. These are the very people who have loved and labored in this town their entire lives and it's no longer even an option for them to stay. These chronic complainers just might find themselves in the same position someday.

When leaves go into the landfill, they often end up buried in lack of oxygen Conditions where they sit for years and years it is same reason that in the ocean if the water is deep enough like the titanic with no oxygen or salt that deep it did not rust. The wooden ships buried underwater in silt or deep in sand in the bay and ocean etc. the wood is not rotted though it may have been eaten by organisisms. Oxygen is a corrosive and needed for anything to breakdown.
I also am playing with my computer and remembered this stuff since in bristol we decided to make a compost station years ago to add longer life to our landfill, and though we have closed the landfill the compost facility is still going strong.
As for RIpolitics idea yea right let the town force a citizen out of his property and take away his livelyhood. Then make the land tax free property of the town. And if they build a compost facility wait till the taxpayers find out how much that cost. " this sounds pretty opposite of many of your post I have seen?" on another note all this because some people want to put a small business out of business. I think changing the zoning to allow businesses to open on the main roads in town would help with the lack of a tax base.Preexsisting nonconforming businesses are doomed to fail,changing the zoning back to commercial would help them survive and employ citizens of the town.Do people wan't it?
Jack, thanks for the factual information. I am not doubting that leaves do not compost properly in the landfill. My sarcasm was making a point that for the 40 years I've been alive the leaves have composted on their own in many a yard in Tiverton........perhaps people should leave (no pun intended) well enough alone sometimes.
I agree this mans land shouldn't be taken from him for a compost station........Tiverton has enough land of it's own already to do that if they want.

You hit it right on the head with the last post. this whole state has been doing that for decades now and towns continue to do it. If you look at Newport with 49% taxexempt properties and the loss of fishing industry and any other industries that made actual products.
You see why this whole state in every town is suffering and why this state is rated so high as being the worst place to open any business. People can not afford to live in the towns they lived all their life when you make it a tourism controled economy that in this case is a short season and not enough to sustain the workers. The low pay and high taxes and cost of living forces people to go live else where.
The straw that broke this states back has allready happened and our polititicians dont care from towns to the state. That is why this businessman is going to have a hard time and it is not right but I fear he will lose.

I did site work for Cawley constructons from 92 to 2006 I work for a roof company now.I do a lot of copper work and some carpentry.I all.so do rubber roof work.Alot of demo work love to take them down.I'm sure you have heard of NP.Roof.

Newport roof is a fun place to work I think I found a home there .Good pay with benifits, lots of work on old homes is what I like so I am happy with it.There are probaly 1 million slates in the basement on vernon ave.If you need some I think we can find your color.
Nope want nothing to do with roofing anymore I did all kinds including tar and gravel. When i did slate I was called an edge walker and sometimes dead man walking because I was young and had no ropes LOL.

There are NO legal dirtbike riding areas in Rhode Island AT ALL! Ray Johnson could turn this into a huge benefit for the town. He has already proven...build a dirtbike park and people will flock to it. Town Council should get on board with this great entreprenurial idea and let Ray make a go of it! And get the kart track on the tax roll also. Let's go Town Council....you need some type of revenue...here it is!

as I'm reading this story the only thing I thought of is why are they going after this guy for taking donations at his dirtbike track when the guys off Fish Road have had a gokart track there for years and yes I know for a fact that they charge people to race there. Our kids finally have a place to ride their dirt bikes and of course people have to complain. And one night when I needed the fire department to come and shut off a loud annoying fire alarm that malfunctioned at a 55 and over retirement communities club house right next to my house(happened quite a few times in the past due to heavy rains, where the fire department had to come and shut it off) they never came, I first called the police at 9 was told they would respond, an hour later I called the police again they did nothing, finally after listening to the loud fire alarm from 9pm-11pm , mind you it was summer and the windows were open, I called the fire department, I figured if the police weren't going to do anything about it I'll call the fire department myself, they always came in the past to shut it off. I was told that someone would respond, needless to say nobody responded until Messanger came in the morning to disarm it. I had to listen to that piercing alarm all night long, they are very lucky that it was not a real fire. I even told them that it was a flashing strobe light and the firefighter did say "yes that is the fire alarm". I was so pissed I called the fire chief and left a message on his voicemail @ midnight, He did contact me to apologize and to let me know that there was a malfunction with the alarm and that it would not happen again. We pay enough taxes in Tiverton our kids need something to do to keep them off the streets and out of trouble.
